SimpleHealth Privacy Notice for California Residents

SimpleHealth, Inc. (the “Company”, “we”, or “us”), along with its parent, subsidiaries and affiliates, offers the website https://www.simplehealth.com/, the SimpleHealth application (the “App”) including all functionalities and services therewith (collectively, the “Services”) that are accessible to authorized users (collectively, “Users”).

Your privacy is important to us. That is why we want you to be informed about how we protect the privacy of users of the Services. Please take a moment to read the following policy, which describes our practices for the collection and use of your information through the Services. Sites that are linked from the Services, or from which you linked to arrive at the Services, may have different policies; please review the privacy policy notices on those sites for details. By using the Services, you are consenting to the collection, use and disclosure of your information as described in this policy. If you do not so consent, do not use the Services.

This Privacy Policy may change from time to time. If we make any changes, we will post the changes on this page and indicate at the top of this page the date the policy was last revised. We will also notify you of any material changes either through a pop-up notice, email or through other reasonable means. Any such changes are effective immediately when we post them and apply to all access to and use of the Services thereafter. Your continued use of the Services after the date any such changes become effective constitutes your acceptance of the new policy.

This Privacy Policy is supplemental to our Terms of Use.

What Information Do We Gather About You?

Information you give us. We receive, store, process and relay on your behalf information that you make available to us when accessing or using the Services. Examples of situations where we may collect information you give us include

  • Filling in any form on the Service, such as registration and placing an order, which requires:
    • a valid email address
    • your first and last name
    • your phone number
    • payment processing information (including a valid credit card)
    • certain health information
    • photo identification
  • Communicating with the Company or providing feedback regarding the Service via email.

Click Data and Device Information.

Our servers may automatically collect non-personally-identifiable information regarding your device and the way you interact with the App, such as the domain name of the service providing you with Internet access, the Internet protocol (IP) address used to connect your computer to the Internet, your browser type and version, operating system and platform, the average time spent on our App, pages/cards viewed, information searched for, access times and other relevant statistics. We also use cookies on our App. Cookies are pieces of information that a web App transfers to the hard drive of a visitor’s computer for record-keeping purposes.

We use clickstream data and cookies only in the aggregate to measure the use of our App and to administer and improve our App. When we collect information, we may extract some of the information and combine it with other information, such as clickstream data. This combined information is used and analyzed only at an aggregate level to help us understand trends and patterns.

Payment Information. When you provide payment information, that information is passed through a gateway that we have set up so that your payment information goes directly to the processor. We do not have direct access to the payment information you provide via the Services and are not responsible for the collection or storage of such information by third parties. We will, however, have access to certain information associated with your purchases, including the amount and date of the purchase.

Information Collected By Third Parties. Some of the services included via our Service are delivered or served by third-party companies. These companies may place or recognize cookies, web beacons, or other technology to track certain non-personal information about users. For example, our third-party service providers may use these technologies to collect information (i) that helps us with traffic measurement, research, and analytics, and (ii) that is used to serve advertisements on our Services and across the Internet tailored to your apparent interests. We do not have access to, nor control over, third party use of cookies or other tracking technologies or how they may be used.

What Do We Do With The Information We Gather About You?

Service Participation. We use the information we collect from you to allow you to participate in the App activities for which the information is collected, including placing orders, and to understand how and why you are using the Service. We may use this information to make the Service better for you, including tracking bugs and other issues. We may place cookies so that we can maintain your session on the Services.

Advertising. We may use the information that we collect about you or that you provide to use to market and advertise the Services, including by displaying our advertisements on other websites that you visit or use. We may also use this information to offer you targeted advertising in order to personalize your experience by showing you advertisements for products and services that are more likely to appeal to you (a practice known as behavioral advertising).

Statistical Analysis. We may perform statistical, demographic, marketing and other analysis of Users and their patterns based on the non-personally identifiable information we collect through clickstream data and cookies. We use this information for internal analysis purposes only.

Automated Messaging. After you place an order, you may send you information about our products and services, and new offerings with the email address you provide us. We may occasionally use your information to administer promotions, sweepstakes and surveys. You may opt out of these communications at any time.

With Whom Do We Share The Information That We Gather?

Within the Company. We may disclose information that we collect through the Services within the Company and to its parent, subsidiaries, and affiliated companies.

Service Providers. Information collected on this App may be disclosed to our licensors and service providers (including but not limited to our web host, API providers and medical practices) for the purpose of providing you the Service. The Company does not always intentionally or deliberately share this information, but it may be available by virtue of integrating these third-party offerings into the App.

Legal Authorities. We may disclose information we collect to third parties as required or permitted by law. For example, we may disclose information:

  • to regulators;
  • to law enforcement authorities pursuant to an official request;
  • to vendors who provide us with services; and
  • to companies that may acquire part or all of Company or an affiliated company.

In Connection With a Transfer of Assets. If we sell all or part of our business, or make a sale or transfer of assets, or are otherwise involved in a merger or business transfer, or in the event of bankruptcy, we may transfer your information to one or more third parties as part of that transaction.

Aggregate Information. We may disclose to third parties information that does not describe or identify individual users, such as aggregate website usage data or demographic reports.

To Others. We may disclose information we collect to others, with your consent to do so.

What Choices Do I Have About How My Information Is Collected, Used and Disclosed?

We strive to provide you with choices regarding our collection, use and disclosure of the information you provide to us. The mechanisms listed below aim to provide you with control over such collection, use and disclosure:

  • Marketing Communications

    If you do not want us to send you marketing or promotional communications, you can opt-out by clicking the “unsubscribe” link in any such promotional emails, checking the relevant box located on the form on which we collect your data or emailing us at support@simplehealth.com

  • Google Analytics

    You can opt out of tracking by Google Analytics by using Google’s Ads Settings or going to https://tools.google.com/dlpage/gaoptout/. You may also opt out of Google marketing products, but please note that this does not opt you out of being served generic ads..

  • Mobile Analytics

    If you are using our App, we use Mobile Device IDs, instead of cookies, to recognize you. We use the Mobile Device IDs and other mobile analytics software to allow us to better understand the functionality of our mobile software on your phone. These Mobile Device IDs are only tracking and collecting Non-Personal Information. The software may record information such as how often you use the Services, the events that occur within the App, aggregated usage, performance data, and where the App was downloaded from.

  • Third-Party Advertising

    If you are interested in more information about tailored advertising and your choices to prevent third parties from delivering tailored web advertisements, you may visit the following websites: http://www.networkadvertising.org/choices/ or http://www.aboutads.info/choices/. These opt-out tools are provided by third parties. We do not control or operate these tools or the choices that advertisers and others provide through these tools.

How Long Is My Information Retained?

We strive to keep your information only as long as we need it for legitimate business purposes and as permitted by applicable legal requirements. If you close your account, we will retain certain data for analytical purposes and recordkeeping integrity, as well as to prevent fraud, enforce our Terms of Use, take actions we deem necessary to protect the integrity of our Services or our users, or take other actions otherwise permitted by law. In addition, if certain information has already been provided to third parties as described in this Privacy Policy, retention of that information will be subject to those third parties’ policies.

You acknowledge that we may establish general practices and limits concerning use of the Services, including without limitation the maximum period of time that data or other content will be retained by the Services and the maximum storage space that will be allotted our servers on your behalf. You further acknowledge that we reserve the right to change these general practices and limits at any time, in its sole discretion. We will endeavor to give you notice of any such change where required by applicable law.

Is My Information Protected?

We try to keep the information we collect from you as current as possible, and we take steps to maintain the security of your information and to prevent unauthorized access to it by those who do not have a legitimate need for it. To that end, we periodically review our security measures. We will never post your e-mail address or other identifying information you have provided on our App without your consent. Please note that no method of transmission over the Internet, or method of electronic storage, is 100% secure.

Miscellaneous

Eligibility. The Services are not intended for California residents under the age of 16 and residents of other jurisdictions under the age of 13. The Company does not knowingly solicit or collect information from or about California residents under the age of 16 and about children in other jurisdictions under the age of 13 on the Services, except as permitted by law. Shine the Light Rights Disclosure. Under the California “Shine the Light” law, California residents may opt-out of a company’s disclosure of personal information to third parties for its direct marketing purposes. As detailed above, you may choose to opt-out of the Company’s sharing of your personal information with third parties for marketing purposes at any time by submitting a request to us by email. It is important to note that this opt-out does not prohibit disclosures made for non-marketing purposes.

International Users. Please note that the Services are directed towards users who reside in the United States. By using the Services, you consent to the collection, storage, processing, and transfer of your information in and to the United States, or other countries and territories, pursuant to the laws of the United States. Some of these countries may not offer the same level of privacy protection as your own.
